By accessing and using LandHunt (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. Huntsland Limited, trading as LandHunt ("Company," "we," "us," or "our"), reserves the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the modified Terms.
2. Description of Service
LandHunt is a UK land and property intelligence SaaS (Software-as-a-Service) platform that provides data and insights about land and properties in the United Kingdom. The Service includes access to both:
- Free Data: Including flood risk assessments, sold prices, crime statistics, demographics, planning constraints, and other publicly available information.
- Premium Features: Accessible through a credit system, including title ownership searches, planning history analysis, company director searches, and advanced lookups.
3. Account Registration and Responsibilities
3.1 Account Creation
To use LandHunt, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree not to share your account credentials with unauthorized third parties.
3.2 Account Responsibility
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to your account or any other breach of security.
3.3 User Information
You certify that you are at least 18 years of age and have the legal authority to enter into these Terms.
4. Billing and Payment
4.1 Subscription Plans
LandHunt offers the following monthly subscription plans:
- Starter Plan: £49/month - 500 credits per month
- Pro Plan: £99/month - 1,200 credits per month
- Business Plan: £149/month - 3,000 credits per month
Additional credit packs are available for purchase:
- 250 credits - £19
- 500 credits - £34
- 1,000 credits - £59
4.2 Billing Cycle
All subscriptions operate on a month-to-month basis. You will be billed on a recurring monthly basis on the same day of each month that you initiated your subscription. All fees are exclusive of applicable taxes unless otherwise stated.
4.3 Payment Methods
We accept payment via credit card, debit card, and other payment methods as specified on our platform. You authorize us to charge your selected payment method for all fees and charges incurred.
4.4 Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for the remainder of your billing period. Any unused credits at the time of cancellation will be forfeited.
4.5 Failed Payments
If payment fails, we will attempt to process the charge again. If payment continues to fail, your account may be suspended or terminated. Late payments may incur additional charges as permitted by law.
5. Credits System
5.1 How Credits Work
Credits are required to access certain premium features on LandHunt, including but not limited to title ownership searches, planning history analysis, and company director searches. Each premium lookup consumes a specified number of credits.
5.2 Credit Allocation
Your monthly subscription plan includes a specific number of credits that are allocated at the beginning of each billing cycle. Additional credits may be purchased separately at any time.
5.3 Credit Expiration
Monthly credits included with your subscription do not roll over to the next billing period and will expire at the end of each month. Purchased credit packs do not expire and may be used at any time.
5.4 No Refunds for Unused Credits
Unused credits are non-refundable. Upon cancellation or termination of your account, all unused credits will be forfeited.
6. Acceptable Use Policy
You agree not to use LandHunt for any unlawful purpose or in violation of these Terms. Specifically, you agree not to:
- Violate any applicable laws, regulations, or third-party rights;
- Engage in any form of harassment, abuse, or discrimination;
- Access or attempt to access data not intended for you or using methods not authorized by us;
- Reverse engineer, decompile, or attempt to derive the source code of the Service;
- Use automated tools, bots, or scripts to access the Service without authorization;
- Resell, redistribute, or commercialize the Service or data obtained from the Service without explicit permission;
- Attempt to gain unauthorized access to our systems or networks;
- Transmit viruses, malware, or any other harmful code;
- Use the Service in a way that could damage, disable, or impair the Service;
- Violate the privacy rights of any individual or organization;
- Use the Service for purposes of data mining or scraping without authorization.
7. Data and Intellectual Property
7.1 Data Sources and Ownership
LandHunt aggregates data from multiple third-party sources, including but not limited to:
- HM Land Registry
- PropertyData API
- Companies House
- Environment Agency
- Office for National Statistics (ONS)
- Additional public and licensed data sources
All data is owned by its respective sources. We are licensed to provide this data to you through LandHunt.
7.2 Intellectual Property Rights
The Service, including all software, design, graphics, text, and content (excluding third-party data), is owned by Huntsland Limited or its licensors. You retain ownership of any data you input into the Service. By using the Service, you are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes in accordance with these Terms.
7.3 Restrictions on Use
You agree not to copy, modify, adapt, translate, reverse engineer, disassemble, decompile, or create derivative works based on the Service without our prior written consent. You may not remove or alter any proprietary notices, labels, or marks on the Service.
8. Data Accuracy and Disclaimers
8.1 No Warranty of Accuracy
While we strive to provide accurate and up-to-date information, LandHunt does not warrant that all data is accurate, complete, or current. Data is provided on an "as-is" basis and may contain errors, omissions, or inaccuracies. We are not responsible for errors or omissions in data obtained from third-party sources.
8.2 Third-Party Data
We do not control or verify third-party data sources. You acknowledge that third-party data may be outdated, incomplete, or inaccurate. We recommend verifying critical information with primary sources, such as HM Land Registry or local authorities, before making important decisions.
8.3 Professional Advice Disclaimer
LandHunt is not a substitute for professional legal, financial, or surveying advice. The information provided should not be considered as professional advice. You should consult with qualified professionals (solicitors, surveyors, accountants, etc.) before making any significant decisions based on information from LandHunt.
8.4 Data Updates
While we endeavor to update data regularly, the frequency of updates varies by data type and source. Some data may be delayed or outdated. We are not responsible for any consequences arising from the use of outdated or delayed data.
9. Limitation of Liability
9.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HUNTSLAND LIMITED, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.3 Cap on Liability
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.
9.4 Exceptions
Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other matter where liability cannot be limited under applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Huntsland Limited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Your infringement of any third-party rights;
- Any content you provide or transmit through the Service.
11. Termination
11.1 Termination by You
You may terminate your account and subscription at any time by visiting your account settings or contacting us. Termination will take effect at the end of your current billing period.
11.2 Termination by Us
We may terminate or suspend your account and access to the Service immediately, with or without notice, if:
- You violate these Terms;
- You engage in illegal or fraudulent activity;
- You breach the Acceptable Use Policy;
- Payment fails and cannot be recovered;
- We determine it is necessary to do so to protect the Service, other users, or ourselves.
11.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. All unused credits will be forfeited. We are not obligated to delete your data, although we may do so at our discretion in accordance with our Privacy Policy.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You hereby submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising out of or relating to these Terms or the Service.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us and providing a detailed description of the issue.
13.2 Legal Proceedings
If informal resolution is unsuccessful, you may pursue legal remedies in the courts of England and Wales as set forth in Section 12 above.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the LandHunt website. Your continued use of the Service following any changes constitutes your acceptance of the modified Terms. For significant changes, we will attempt to provide notice through email or within the Service.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Huntsland Limited regarding the Service and supersede all prior negotiations, representations, and agreements, whether written or oral.
